NHS England concedes it must respect patients' data opt-out rights

Following legal pressure from the Good Law Project, NHS England has conceded that it must assess all patient requests that their medical records are used solely for their healthcare and not for research purposes. In the past, the NHS had claimed that patients' right to opt out was no longer applicable after the NHS Federated Data Platform (FDP) contract was awarded to Palantir.

The acknowledgement means NHS England will now consider each patient's opt out request each time. In addition, NHS England confirmed that it will consider the balance between the benefits of sharing data and the individual's right to control their information, as required by law.
